Strike – National Stay Away – August 2008

COSATU and the Taxi Association have called for a National Stay Away on the 6th August 2008. COSATU have done this with conjunction with the Taxi Council and the Taxi Association. This is to protest against the rapid increases in the price of food and petrol.
Whilst this is called a National Stay Away the reality is that is a National Strike. As it falls within the ambit of Section 77 of the Labour Relations Act (Act 66 of 1995) it is a strike which complies with the Act and therefore is a protected strike. Consequently any person participating in the strike is not in breach of his/her contract of employment.
Employers are not obliged to pay the employee for not attending work.









I don’t understand your last sentence which says “Employers are not obliged to pay the employee for not attending work.” We get paid because we work so if we were not working, our salary will not get cut. Is this what you mean? Sorry if I’ve made some mistakes.
Labour Law is clear if you work you get paid if you don’t work you don’t get paid, unless you are on paid sick leave or paid leave.
